Subject: Review proposed changes to existing Town By-Laws
Select Board Members Present: Michael Storch, Chairperson, Wayne Burkhart
Also in attendance: Sarah Hudson of Tyringham
Items Discussed:
1. In original copy, in the Table of Contents, Article V says: Unregistered and Dilapidated vehicles”, in the most recent copy of the By-Laws the word “Dilapidated” has been left out. Was this intentional?
2. In an OLD copy, on page #3 section #4 the last sentence: S”See also article XV” is missing in latest edition.
3. Question on page #5 section #9 parts “d” and “e”
4. In Article II, section #10: is it being done presently? Is it redundant and needed?
5. Will section #15 of Article #2 have to be changed? See item #13 below
6. Personnel Polices in section #6 on page #15 in OLD book in new book is now on page #37.
7. Wasn’t Article XVI, on page #28 in new book amended or removed?
8. Mandatory Recycling, Article X, page #33 in old book shows the penalty being $25.00, on page 31 in new book it’s $100.00, with no revision date.
9. Pages #32 and #34 are not in original By-Law book.

10. Selectboard needs to write an advisory By-Law regarding STEEP ROAD WINTER ACCESS and Monterey’s liability if the Towns emergency vehicles can not access the property in times of emergency or fire.
(Sarah Hudson thinks that Tyringham may have written such a By-Law and will try to get a copy for the Selectboard).
11. Need to review ALL sections in Article XIII & XVI, ALARMS and Volunteer Fire Dept. Real Estate Tax Exemptions, with Ray Tryon and Don Torrico.
12. Need to write either a NEW Article or add to the existing DOG RESTRAINT Article XII, a regulation and fine for violations of bringing dogs and other pets to the Public Beach. It’s been recommended that said
fines should be similar to the fines imposed in Article XII: $25.00 for first offense, $50.00 for a 2nd offense and $300.00 for a 3rd or subsequent offense.
13. Need to redefine Section 15 article II; Salary Commission. The change proposed is to entitle the Section: COMPENSATION COMMISSION with a full description of what is expected of it. It’s been recommended that it be comprised of five, (5)
members: one from the Selectboard, one from the Finance Committee, one from the Public at large and two from the full-time employees.
